Abstract

J.M. Emmerson's article examines both reasons for advice and a decision (handed down, respectively, by the Privy Council and the High Court of Australia) from 1976 concerning the application of British statute to Australian ships on the high seas, and attempts to reconcile these decisions.  The article also examines the history of British maritime legislation as applied to Australia, through a range of past cases.
