Abstract

Clarkson's comprehensive paper explores the relationship of coastal States to their offshore waters, and what rights and duties the States possess in relation to them, examining various UN Conventions on the law of the sea including UNCLOS (then in infancy). Following this consideration of issues in the international field, Clarkson addresses developments in Australia, including constitutional issues between the Commonwealth and the States, exemplified by the Submerged Lands Case and later state and federal agreements for the settlement of offshore constitutional issues in 1979-1980. NZ is also briefly considered in relation to its Territorial Sea and Exclusive Economic Zone Act.
