Abstract

Macfarlan considers a range of topics as part of his broader discussion of pure economic loss in the maritime context, including: the traditional common law stance on this form of recovery, gradual inroads into the common law principles through case law, the floodgates argument, and the suggested test. Macfarlan argues that the principle of proximity, in such cases, should be recognised as the touchstone for recovery.
