Admiralty Practice After Crawford Papers: Part IV - Implementation

Abstract

This part looks at government implementation of the new draft Admiralty legislation, the procedures adopted in consideration of the report, and some of the issues raised with the Australian federal government in the course of that consideration. In terms of the latter, some questions were: what courts should be invested with Admiralty jurisdiction; whether Australian ships should be liable to arrest, the range of personal injury claims to be included within Admiralty jurisdiction, and State statutory rights of detention.
