Abstract

In this address, Street co-relates the functions of the court system and ADR procedures in the resolution of disputes, as a topic relevant to maritime law more broadly. Four types of arbitration are touched upon: international commercial arbitration, domestic arbitration, arbitration which involves submitting a dispute to an expert appraiser, and court-ordered arbitration. Street also considers the mechanics of mediation, and the use of arbitration clauses in commercial shipping contracts.
