Abstract

In this paper, the author gives an outline of the New Zealand Transport Law Reform Bill (now called the Maritime Transport Bill), isolating the major changes it makes, and explains the effects or some of the effects it will have on NZ ships and shipowners.

The author analyses and critiques aspects of the Bill, such as the wording of the alternative Clause 240 on Coastal Shipping, and Clause 39 (Acceptance of Documents) which would permit the government to accept international trading certificates from all around the world, including from countries with low levels of compliance. Suggestions are made as to possible amendments. In addition, the author criticises aspects of the Resource Management Act 1991 (NZ).
