Abstract

Perkins provides a commentary on the paper by Martin Davies, presented as part of Business Session 1, chaired by Paul Willee. Perkins refers to the 1998 amendments to the Carriage of Goods by Sea Act 1991 (Cth) in Australia, stating that there should be little difficulty in applying the new Regulations in claims brought in New Zealand where Australian law applies (such as where Australian-generated contracts are involved). Perkins generally considers the effects of the Australian reforms on New Zealand and the differences between their respective carriage of goods by sea legislative regimes. The author concludes by suggesting that the Australian amendments are going to raise interesting issues in marine cargo claims heard by New Zealand courts where transportation emanates from Australia.
