Abstract

Alan Walls presents this paper as part of Business Session 8. Walls considers the case of the Indian Grace and the House of Lords judgment in which their Lordships analysed the difference between a claim 'in rem' and a claim 'in personam', as well as the Arrest Convention 1999 and the new Admiralty Practice Direction relating to arrests. Finally, Walls considers the case of the Herceg Novi and the issues of forum shopping and limitation of liability.
