Abstract

In this paper, MacDonald focuses on general maritime claims and, more specifically, the issue of beneficial ownership as it relates to arrest proceedings against sister ships. In the first part of the paper, MacDonald looks at the commercial aspects of the beneficial ownership issue in respect of sister ships. The second part is presented by James Allsop and can be viewed separately. Allsop's paper looks at the litigation aspects of the beneficial ownership issue and provides a more detailed analysis of the legislation and case law.
