Abstract

This paper was presented as part of Business Session 8, on the topic of 'The New Direction for Marine Litigation', which was chaired by Barton Phillips. The first page of the paper contains a short biography of the author.

In this paper, East looks primarily at England and the Woolf Reforms (with regard to civil litigation), discussing briefly the reasons behind their introduction and then whether, two years or so on, they are working as they should. East then contrasts some other jurisdictions to highlight how other countries deal with civil litigation, and finishes with a few thoughts as to how things might be improved to be more efficient.
