Abstract

This paper was presented as part of Business Session 2, on the topic of 'Issues in Marine Insurance', which was chaired by Michael Fisher. The second page of the paper contains a short biography of the author.

In this paper, Myburgh first analyses existing US and English marine insurance case law on war risks and terrorism, and secondly examines the insurance coverage of potential future acts of maritime terrorism in the light of existing jurisprudence, discussing future trends in this area. Myburgh looks in particular at interpretations of the meaning of 'war' and 'civil war', especially in cases involving insurance policies with war risks clauses, and interpretations of the words 'revolution, 'rebellion', 'insurrection', 'terrorism', and the phrase 'hostile act by or against a belligerent power'.
