Abstract

This paper was presented as part of Business Session 6, on the topic of 'Coming to Grips with some Currently Emerging Issues', which was chaired by Michelle Taylor. The second, fourth and fifth pages of the paper contain a short biography (and CV) of the author, while the third page contains a description of the author's firm, Maloof Browne & Eagan LLC. The sixth and seventh pages contain an article written by the author for 'The Maritime Advocate'.

The bulk of the paper contains the slides for Maloof's presentation on trends in the handling of cargo recoveries in the United States. The five trends identified by the author are as follows: 1. Problems in Extending Time Limits; 2. Most But Not All Forum Selection Clauses Apply; 3. It's Faster and Easier to Prove the Case; 4. More Exceptions to Package Limits; and 5. Air Law Now Varies By Route.
