This paper was presented by Ron Salter (in the author's absence) as part of Business Session 1, on the topic of 'Insuring Marine Risks in the Modern Day', which was chaired by Peter McQueen. The third page of the paper contains a short biography of the author.

In this paper, Martin-Clark explores the decision of and judgment in David George King and Ors v Brandywine Reinsurance (UK) Ltd, anticipating that it may assist in clearing the problem of excess of loss claims arising from the Exxon Valdez oil disaster.
