Judicial Sales and the New Convention

Abstract

This paper considers the nature of judicial sales of ships in connection with the enforcement of maritime claims and the private international law problems that can arise from them. It provides an overview of the key provisions of the new United Nations Convention on the International Effects of Judicial Sales of Ships and the implications for Australia, including what legislative changes may be required if Australia ratifies the Convention.
