General Average, Salvage and the Contract of Affreightment

Crump's article focuses first and foremost on the topic of general average, while examining the relationship between this topic and contracts of affreightment, as well as the effects of the York/Antwerp Rules. Crump argues that general average arises directly from a contract of affreightment, in part because rights of recovery in general average are linked to the terms of the contract of affreightment, and also the rules to be applied in adjusting general average are linked through the terms of the relevant charterparty or bill of lading.
